Rod Sims, Chair of the Australian Competition and Consumer Commission (ACCC), recently kicked off a debate on competition policy in Australia by setting out what he considered are the main problems with the merger control regime, and his proposed solutions.

Merger control can have a substantial effect on the mergers that take place in Australia, and great care must be taken because merger decisions are usually final. A merger that is allowed to take place cannot be undone easily and a merger that is blocked will not usually be attempted again. …
