WWO fined $24m for criminal cartel conduct
On 18 June 2020 Wilhelmsen Ocean AS (WWO) pleased guilty to criminal cartel conduct. It has now been convicted and ordered by the Federal Court to pay a fine of $24 million.
Not the ice cream!
The ACCC has instituted Federal Court proceedings alleging Peters Ice Cream engaged in conduct ‘which hindered or prevented competition for the supply of single-wrapped ice creams to petrol and convenience retailers.’
ACCC alleges FE Sports engaged in RPM
The ACCC has instituted proceedings in the Federal Court alleging B&K Holdings (Qld) Pty Ltd (t/a FE Sports) ‘engaged in resale price maintenance for the wholesale supply of cycling and sporting products in Australia’ by providing dealer agreements containing terms prohibiting advertising or promoting certain products at less than the RRP.

Glencore has won its appeal over access charges to Port of Newcastle. The matter has been remitted to the Tribunal.

Shipping company Wallenius Wilhelmsen Ocean AS (WWO) has entered a guilty plea to criminal cartel conduct in the Federal Court today.
ACCC loses bid to stop Garuda appeal
The ACCC has been unsuccessful in its attempt to stay Garuda’s appeal against a $19 million cartel penalty, despite its failure to pay the penalty.
ACCC strikes out on PN Aurizon appeal
The ACCC has dismissed the ACCC’s appeal against a 2019 Federal Court decision which found that Pacific National’s acquisition of Acacia Ridge Terminal in Brisbane would not substantially lessen competition as a result of undertakings given by PN. As a result of the appeal the acquisition can proceed without that undertaking.
Federal Court allows TPG merger
The Federal Court has declared that the proposed merger between TPG and Vodafone would not substantially lessen competition.
B&K Holdings v Garmin dismissed by consent
The private proceedings by B&K Holding against Garmin Australasia (QUD66/2018) have been dismissed by consent and without admissions (18 November).
Judgment reserved in Vodafone/TPG case
The trial in the Vodafone/TPG merger case has concluded and judgment reserved. A decision is not expected until at least February 2020.
